Confiscated the bronze of Lysippos: success of the State Attorney for the recovery and protection of cultural heritage
On 11 February 2010, the Court of Pesaro ordered the confiscation of the statue of the victorious athlete attributed to Lysippus, confirming the effectiveness of the action carried out by the State Attorney's Office in support of the recovery and defense policy of archaeological assets in concert with MIBAC and the command of the carabinieri for the protection of cultural heritage. The provision constitutes the end of a long judicial affair which began in 2007 with the complaint of the association "The Hundred Cities". A first confiscation of a fragment of the marine concretion that originally covered the statue was obtained by the then procurator Gaetano Savoldelli Pedrocchi. The fragment is now kept at the superintendency of Ancona. The story was complex, involving criminal law profiles and civil aspects of public and private international law. The decision represents the affirmation of full law of the Italian state, both in light of the internal legal system and of the international one, as proof of a firm and original conviction of the public prosecutor and the State Attorney's Office regarding the essentially juridical nature of the story, even before ethics and culture. It was precisely on a strictly juridical level that it had to be resolved. The coincidence between the principles of law and evident ethical principles and cultural reasons is grounds for applause for the confiscation obtained.
