Attorney General
The nomination
The appointment of the Attorney General implies a set of discretionary assessments left to the exclusive competence of the Council of Ministers. It is made by decree of the President of the Republic, on the proposal of the President of the Council of Ministers following a resolution of the Council itself (art. 30, TU 1933). The Attorney General expresses the unitary direction of the State Attorney's Office, and therefore coordinates, gives impetus and directs the institutional activity. This is one of the cornerstones of the organization of the Institute since the regulation of 16 January 1876, n. 29, reiterated in the TU of 1913, and then in that of 1933. Art. 17 of the TU of 1933, taking up art. 2 of that of 1913, assigns the direction of the Institute to the Attorney General; and the art. 15 of the first, taking up art. 13 of the second, provides: "The Attorney General of the State makes all proposals for appointments and for any other provision concerning the staff of the State Attorney's Office; supervises the progress of the service; supervises the handling of contentious and consultative affairs with general instructions and special directive norms; resolves differences of opinion both between the district offices of the State Attorney's Office and between these and the administrative offices. The general advocate reports to the Head of Government on the progress of the work of the State Attorney's Office by submitting appropriate reports".
Functions

The State Attorney General:
-
determines the directives relating to the handling of contentious and consultative affairs;

presides over and convenes the council of state lawyers and prosecutors and the advisory committee;
-
supervises all the offices, services and staff of the State Attorney's Office and supervises their organisation, giving the appropriate provisions and general instructions;

resolves, after consulting the advisory committee, differences of opinion both between the district offices of the State Attorney's Office and between them and the individual administrations;

assigns litigation and consultative affairs to lawyers and prosecutors serving at the State Attorney General's Office, based on the criteria established by the consultative committee;

periodically reports to the President of the Council of Ministers on the activity carried out by the State Attorney's Office, presenting specific reports, and also promptly reports any legislative deficiencies and interpretative problems that emerge during the institute's activity;

makes proposals and adopts measures expressly attributed to its competence, as well as any other measure concerning the offices and personnel of the State Attorney's Office that is not attributed to another authority.
In case of impediment or absence, the Attorney General is replaced by the Deputy Attorney General with greater seniority in the position.
The Deputy Attorney General replaces, in cases of absence or impediment, the State Attorney General and assists him in the tasks entrusted to him (see paragraph 4, art. 6 bis, DL 24-12-2003 n. 354).

Lawyer Gabriella Palmieri Sandulli
born in Naples on 7 April 1958.
Graduated with top marks in law from the Federico II University of Naples in October 1980, in 1982 she won the competition for State Prosecutor, the competition for Judicial Auditor and passed the exams for Legal Prosecutor.

- In 2000, legal advisor to the Extraordinary Government Commissioner for the assessment, settlement and payment of compensation relating to the Cermis cable car accident.
- From 2000 to 2002 Consultant to the Commission for International Adoptions.
- From 2006 to 2007 Head of Cabinet of the Minister for Cultural Heritage and Activities.

- In 1997 President of the Disciplinary Board of the Court of Auditors designated by the President of the Court of Auditors.

- From October 1997 to December 2000, reconfirmed for the three-year period 2000 – 2003.
- Member of the Central Supervision Commission for Economic and Popular Housing at the Ministry of Public Works.
- From June 2000 to June 2003 Member of the Commission for the study of relevant issues and Juris Web at the Authority for the Supervision of Public Works.
- He collaborated in the defense panel of the Italian State sued by the United States Government before the International Court of Justice in The Hague in 1988/89, which concluded with a ruling rejecting the application.
- In July 1998 he carried out a study assignment given by the Minister of Public Works to draft a regulatory text for the merger of the Department of Urban Areas with the Ministry of Public Works and Transport.
- Member of the Commission established in 2001 at the Ministry of Public Function and chaired by the Minister for the examination of legislative initiatives regarding administrative action and citizen protection and the revision of law no. 205/2000.
- Member of the Commission established in March 2004 by the Minister of Foreign Affairs for the simplification of development aid procedures.
- From 2002 to 2006 General Secretary of the State Attorney's Office.
- From 2008 to 2012 President of the Committee for Equal Opportunities for Lawyers and State Prosecutors established in the same year.
- Since January 2008, designated representative of the vigilant Ministry of University and Scientific Research on the Board of Directors of the LUMSA University of Rome; role renewed for the following four-year period 2011-2015.
- Since November 2008 appointed by the Minister of Education, University and Scientific Research as President of the Commission for the evaluation of applications from special scientific bodies for the granting of contributions; role renewed for the three-year period 2011-2013.
- Since February 2009 - following a merit-based scrutiny by the High Court of Sports Justice - included as an expert in the list for the appointment of Referees at the National Court of Arbitration for Sport - role renewed in June 2013.
- From 2014 until August 2019 Member of the Sport Guarantee Board with functions of Deputy President of the Second Section.
- From 18 January 2022 appointed President of the Coni Guarantee Board.
- Since April 2009 appointed by the Minister of Foreign Affairs as Agent of the Italian Government before the Court of Justice and the Court of the European Union.
- From December 2009 to December 2015 member of the Advisory Committee of the State Attorney's Office.
- From October 2012 to April 2016 included in the structure of direct collaboration with the Attorney General Michele Dipace and Massimo Massella Ducci Teri.
- In November 2013, appointed by decree of the Minister for Regional Affairs and Autonomy, Graziano Delrio, President of the Commission establishing the "Giulio Onesti" lifetime allowance for Italian athletes in serious economic difficulty and who have honored their homeland.
- Since May 2016 designated by the Council of Ministers as a member of the OMRI - Order of Merit of the Italian Republic chaired by the President of the Republic.
- From September 2014 to September 2019 member of the CCASIIP - Coordination Committee for the High Surveillance of Infrastructures and Priority Settlements at the Ministry of the Interior. Since July 2015 designated member of the working group at the Ministry of the Interior for the drafting of anti-mafia measures.
- On 29 December 2015 appointed Government Agent by the Minister of Foreign Affairs and International Cooperation in the dispute initiated by Panama against Italy M/N Norstar v. Italy before ITLOS - International Tribunal of the Law of the Sea.
- Since November 2015 member of the international legal team that follows the international litigation for the affair of the two marines (Enrica Lexie case) brought against India before the Courts of The Hague and Hamburg.
- With Presidential Decree dated 19 April 2016, the role of Deputy Attorney General was conferred.
- In March 2017 appointed member of the public competition commission for 8 official positions at the Presidency of the Republic by decree of the General Secretary of the Presidency of the Republic.
- Since May 2017 member of the Study Commission established by the President of the CNR to assist him in identifying the most appropriate solutions to ensure the efficiency and transparency of the CNR's administrative procedures.
- Since June 2017 member of the advisory board of LUMSA University.
- In November 2017 appointed by decree of the Minister of Health President of the Commission for the formation of the national list of subjects eligible for the appointment of Director General of local health authorities, hospitals and other bodies of the National Health Service.
- By decree of the State Attorney General dated 8 March 2018 appointed President of the Commission for the competition for State Attorney.
- Appointed in May 2019 President of the examining commission of the public competition, based on qualifications and exams, for a manager with an international legal profile in the role of the Guarantor for the protection of personal data.
- With Presidential Decree dated 8 August 2019 she was appointed State Attorney General.
- With Presidential Decree dated 12 September 2019 she was awarded the honorary distinction of Knight Grand Cross of the order "For Merit of the Italian Republic".
