Council of Lawyers and State Attorneys
"The council of advocates and state prosecutors, in addition to exercising the powers of the permanent commission for state attorneys and attorneys provided for by the royal decrees of October 30, 1933, numbers 1611 and 1612, and subsequent amendments, shall:
- to express an opinion on the distribution of attorneys and state attorneys between the Attorney General and the district attorneys on the basis of criteria predetermined by it;
- to express an opinion on the assignment of first-appointed lawyers and attorneys to the various offices and with regard to any request or proposal for transfer;
- to formulate the judgments referred to in articles 2, 3 and 5 of Law 103/79 and to re-examine the unfavorable judgments after two years;
- to decide the appeals proposed by lawyers and state prosecutors against the measures referred to in article 19 of this law;
- to express an opinion on the conferral of the positions of Deputy Advocate General of the State, of District Attorney of the State and of Secretary General, pursuant to articles 16, 17 of this law, as well as on the out-of-office placement of State lawyers;
- to express an opinion on the conferral of any type of office to lawyers and state prosecutors;
- to exercise the functions of the disciplinary commission vis-à-vis lawyers and state prosecutors pursuant to article 24 of this law;
- to designate the state lawyers who are to be members of the advisory committee.
The acts of the council are public and the lawyers and state prosecutors can view them and extract a copy "(Law 103/79, art. 23, first paragraph). at the expense of lawyers and state prosecutors.
