Requirements for access to the forensic practice

The requirement for admission to the selection is a law degree.
In order to ensure adequate preparation for young trainees, only graduates who have to carry out no less than 12 months of practice on the expiry date of the application submission deadline can be admitted to practice forensics at the Avvocatura dello Stato ( DAG n.12604 on 8 May 2013).

Students are admitted to the practice at the State Attorney's Office following a selection based on qualifications only, based on the average between the degree grade and the grades obtained in the subjects that are the subject of the written exams for registration in the professional register and for the competition as state attorney (private, civil and commercial law, civil procedure, substantive and procedural administrative law, criminal law and criminal procedure).

Each aspirant is assigned a score calculated as follows:

NOTES :

  • In particular, for courses of study with a Specialized Degree, the average in the subjects is calculated over both the three-year and two-year periods (as if it were a single course of study) and for the degree grade only that of the Specialized Degree is taken into consideration;
  • Only the fundamental / compulsory exams are considered, with the exception of Administrative Procedural Law, where envisaged as not compulsory;
  • If the study plan does not include the Civil Law exam, only the Private Law exam will be taken into consideration;
  • The Civil Law average also includes Contracts and Obligations;
  • The Administrative Law average also includes Administrative Procedural Law, where supported.

In accordance with this score, a ranking is drawn up, and admission to the apprenticeship is proceeded, until the available places are completed.

In the event of a tie, candidates will be admitted in ascending order of age.

The development of the practice

The practice at the State Attorney's Office lasts no longer than the minimum period required by law and essentially consists of two profiles:

  1. Theoretical-practical training, by supporting a State Lawyer and participating in the drafting of documents and opinions, as well as in the conduct of doctrine and jurisprudence research.
  2. Participation in hearings, especially before the offices of the civil judiciary, through insertion in a shift (mostly weekly), carried out alongside the State Prosecutors, or before the various judicial offices alongside the State Advocate.

For the rest, since the legal practice is essentially aimed at obtaining the qualification for participation in the qualifying examination for the profession of lawyer, the rules relating to the various formal requirements (such as the compilation and presentation of the practice booklet at the end of each semester) are those established by the competent Council of the Bar Association.

Carrying out the forensic practice at the State Attorney's Office does not give the right to reimbursement of expenses provided for by article 9 of Legislative Decree 24 January 2012 n. 1 conv. with mod. in L. 24 March 2012 n. 27, pursuant to paragraph eight of the aforementioned provision.

Presentation of the application

Those wishing to take part in the selection must send a specific application (to be sent in .pdf format) duly completed in all its parts to the Personnel Office of the Advocacy where they wish to carry out the practice ( General Advocacy or District Lawyers ) under his own responsibility all the requested data and attaching a copy of the front and back of the identification document.

The submission of the application also entails having read this information on the processing of personal data pursuant to art. 13 of the General Data Protection Regulation (EU) 2016/679.
To submit the application it is not necessary to be resident in the Court of Appeal of the Bar of Interest; the change of residence can be made after any admission, in order to be registered in the Register of practitioners.
